Judgment

Heard Ms. A. Barua, learned counsel for the applicant who has submitted that the legal heir of the deceased petitioner who is also her son has filed this application with a prayer to be impleaded in this proceeding in place of the deceased petitioner. However, it is also submitted that there is also another legal heir of the deceased petitioner, who is the daughter of the deceased petitioner as well as the sister of the applicant herein, who has not filed any application for substitution in place of the deceased petitioner. If the applicant is allowed to be substituted in place of the deceased petitioner, it is prayed that an opportunity be given for notice to be issued upon the other legal heir as an abundant caution.
On consideration of the prayer made, this application is allowed. The applicant is hereby substituted in place of the deceased petitioner and as prayed for let notice be issued upon the other legal heir.
Let notice be made returnable within 2(two) weeks.
