Bibhash Chandra Pathak vs The State of Bihar and Others

This Letters Patent Appeal has been filed against an order dated 1 May, 1997 in C.W.J.C. No. 5775 of 1996, Bibhash Chandra Pathak v. State of Bihar and Ors.

The facts have been sufficiently noticed in the order which has been challenged.

Petitioner''s father died in 1980. By that time the Petitioner was a minor. He passed his matriculation examination in 1983. After he attained the ago of majority whenever he may have, 16 years later, that is to say after his father''s death, the Petitioner files a writ petition.

The Petitioner seems to be forgetting that this is High Court''s writ jurisdiction. 16 years delay to seek a relief that he be given an appointment on compassionate ground, the relief cannot be had for the askance. A minor cannot be considered. Then, it is only a policy of the government one cannot wait until the Petitioner becomes a major. The Petitioner took 16 years to come to the Court. The learned Judge has rightly declined to interfere on the writ petition.

Dismissed.
