Mr.D.Rajaboopathy, learned Government Advocate (Criminal Side) takes notice for Respondents 1 to 3.

The prayer in the Writ Petition is to direct the 2nd respondent to take immediate action upon the petitioner's representation dated 29.07.2026.

The brief facts necessary for the disposal of the present petition are that the petitioner entered into a lease agreement with one Vasunthradevi for taking the house situated at No.29, Keela Sayakkara Lane, Samaspiran street, Trichy, on lease for a lease amount of Rs. 6,00,000/-. Accordingly, lease agreement was entered on 23.07.2025 and on that day the petitioner paid a sum of Rs.2,00,000/- as advance. The petitioner agreed to pay the balance amount of Rs.4,00,000/- on or before 28.07.2025. Further facts reveal that the rival party Vasunthradevi demanded the balance Rs.4,00,000/-, which enable her to settle the tenant to vacate and hand over the vacant portion to the petitioner. Believing her words the petitioner paid the remaining amount of Rs.4,00,000/- also in advance to the lease and Rs.6,00,000/- has been paid. As assured by her, the said Vasunthradevi did not hand over the portion to the petitioner. Therefore, the petitioner realized that Vasunthradevi cheated the petitioner, so she made a complaint to the 1st respondent police, but no action has been taken as on date.

The Learned Government Advocate (Criminal Side) appearing for the respondents submitted that, the petitioner sent the complaint to the 1st respondent police and later it reached the 3rd respondent police only on 09.08.2026 and thereafter CSR No. 0293 of 2026 has been registered on 30.08.2026, and the same is pending for enquiry.

Recording the above submission, the 3rd respondent police is directed to enquire the matter by examining the petitioner as well as the land owner of Vasunthradevi after issuing summons under Section 64 of BNSS and take a better decision within a period of 6 weeks from the date of receipt of the copy of the order.

With the above direction, this Writ Petition is disposed of.
