Alok Singh, J.—Record reveals that petitioner was issued Passport bearing No. G7894705 on 11.4.2008 for 10 years by respondent No. 3-Regional Passport Officer, Sector 34, Chandigarh. The petitioner applied for issuance of Passport Clearance Certificate qua his aforesaid valid Passport since the same was required by him for submission to the USA Embassy for grant of travel Visa. However, Passport Clearance Certificate has not been issued to the petitioner saying that his name was included in the surveillance list on account of the fact that his brother and brother-in-law are perceived to be terrorists.

Learned counsel appearing for respondents No. 2 and 3 fairly states that Passport issued to the petitioner bearing No. G7894705 has not been impounded/ cancelled or revoked by exercising the powers provided u/s 10 of the Passport Act.

Respondents No. 2 and 3 could have impounded or revoked the Passport if there exist any valid ground for doing so. Since the Passport has not been impounded or revoked as yet on the grounds mentioned under the provisions of the Passport Act, therefore, non issuance of Passport Clearance Certificate seems to be totally unjustified and the petitioner is entitled for Passport Clearance Certificate.

The present present is allowed. Let request of the petitioner for issuance of Passport Clearance Certificate be considered within 30 days and decision taken thereupon shall be communicated to the petitioner.
