The petition for grant of passport is resisted by the State on the ground that he has come under surveillance from the IB and that he has been kept under a watch. His name figures both under the Union War Book List and the Information Sheet, which is necessary for the State surveillance for the year 2009. I called for the documents and I find that the petitioner''s name also figures in the list. The State has a reason why it is not favoured. Learned counsel for the State says that the list was last prepared in 2009 and that this is reviewed every three years. The next review will be undertaken in 2012. The petitioner will be at liberty to apply afresh for a passport after 2012. There is a ground as contemplated u/s 6(A) for denial of passport of the petitioner. I do not think that it will be appropriate for Court to interfere in the matter where the Executive has a reason to keep the petitioner''s activity under surveillance. The petition for issuance of passport is dismissed for the present.
It shall not, however, bar the petitioner from applying afresh at an appropriate time and the State shall review his activities in an objective manner and then consider, if he does so, after May, 2012 when the list is prepared.
