5 paragraphs · 245 words

Learned counsel for the applicant submits that although the direction of this Tribunal was to decide the pending representation of the petitioner, the same was required to be considered in light of the judgment of the Hon’ble Supreme Court in Union of India vs. G. Kiran and Others, 2026 SCC OnLine SC 22, read with the DoP&T Office Memorandum dated 01.07.1998. However, the respondents have once again denied due promotion to the petitioner and rejected his representation vide order dated 24.07.2026.

2.

Learned counsel for the respondents submits that the judgment in G. Kiran and Others (supra) pertains to direct recruitment and is not applicable to the case of the petitioner, whose grievance relates to reservation in promotion.

3.

Learned counsel for the petitioner further submits that, as a counterblast to approaching this Tribunal, the petitioner has been transferred and subjected to a minor penalty.

4.

Having considered the submissions, we do not propose to enter into these issues at this stage. So far as the directions issued in the present Contempt Petition are concerned, the order of the Tribunal stands complied with by passing of the speaking order dated 24.07.2026, and the compliance affidavit filed by the respondents is placed on record.

5.

Accordingly, the Contempt Petition (C.P.) is closed. Liberty is granted to the petitioner to agitate his surviving grievances, if any, in accordance with law by way of appropriate fresh proceedings. Pending MA, if any, also stands disposed of. Notices are discharged.
