This anticipatory bail application under Section 482 of the Bharatiya Nagarik Suraksha Sanhita (BNSS), 2023, has been preferred by the petitioner apprehending his arrest in connection with Pratappur P.S. Case No.127 of 2024, for offences under Sections 191(2), 191(3), 190, 127(2), 115(2), 109(1), 132, 121(1), 326(f), 326(g), 309(5) & 61(2) of the Bharatiya Nyaya Sanhita, 2023 and Sections 3 and 4 of Prevention of Damage to Public Property Act. The case is presently pending before the Court of learned Sub Divisional Judicial Magistrate, Chatra.
Heard learned counsel for the petitioner and learned counsel for the opposite party – State.
After an accident had taken place, this petitioner and others became unruly and started damaging the Government properties. They even damaged the ambulance and assaulted the driver of ambulance with an intention to kill him. They also destroyed the gate of the Police Station and broken the lock.
Considering the aforesaid allegation, this is not a fit case to grant anticipatory bail to the petitioner.
Accordingly, this Anticipatory Bail Application is dismissed.
The petitioner is directed to surrender before the Court below and pray for regular bail.
