Judgment
Mr. Rahul Jaiswal, witness-PW-1 is adduced by the Petitioner for his further cross-examination on behalf of Respondents No.3 and 5. It would not be out of place to recall that earlier the witness was cross-examined on behalf of Respondent No.2 who has concluded his cross-examination on 20.1.2023 and further cross-examination was deferred to the next date on the prayer of the learned Proxy Counsel appearing on behalf of Mr. Akshay Singh, learned counsel for Respondents No.3 and 5.
It is needless to mention that the matter proceeds ex-parte against Respondents No.1 and 4 in terms of the Order dated 10.12.2018.
The matter is pending since 20.1.2023 for cross-examination of the Petitioner's witness on behalf of Respondents No.3 and 5 alone who have been given sufficient accommodation still nobody appears on behalf of the Respondents No.3 and 5 today.
Let the matter be placed before the Hon'ble Bench at an early date for considering the prayer of the Petitioner for foreclosure of the right of Respondents No.3 and 5 to cross-examine his witness. The matter may be listed before this Court thereafter for cross-examination of the Defendant's witness.
