This petition has been filed for review of order dated 28.01.2025 passed in Cont. Case (Civil) No. 821 of 2023 read with order dated 17.05.2023 passed in W.P.(L) No. 209 of 2003 and LPA No. 498 of 2019 (order dated 24.11.2022 and Award dated 25.10.2000)
The learned counsel for the petitioners has submitted that in Cont. Case (Civil) No. 821 of 2023 it has been observed that it was for the petitioners to get the award executed through the process of law as provided under Industrial Disputes Act, 1947. He has submitted that the industrial tribunal is non-functional for last 4 ½ years and therefore the petitioners have filed this review petition.
This court is of the view that such ground cannot be a ground for seeking a review of the order. Accordingly, the review petition is dismissed.
I.A. No. 15163 of 2025 has been filed for condonation of delay of 224 days in filing this civil review application.
It has been mentioned therein that the civil review application has been filed for review of the order passed in Cont. Case (Civil) No. 821 of 2023 so as to get the fruits of the order passed by this court and there has been delay in filing this petition as the industrial tribunal is non-functional for 4 ½ years.
Since on merit, this court is not inclined to entertain this review application, the petition seeking condonation of delay is also dismissed.
