Judgment
Heard learned counsel for the petitioner.
Petitioner has been awarded license for Yatri Mitra Kiosk for a
period of 3 years with effect from 1st January, 2014 to 31st December, 2017
to provide amenities and facilities to passengers and visitors at Airport as
per letter dated 31st December, 2013 (Annexure-1) issued by Airport
Director, Birsa Munda Airport, Ranchi and the agreement dated 11th June,
2014 entered into with them. Petitioner has complained before respondent
no. 1, Airport Director, Birsa Munda Airport, Ranchi through letter dated
16th January, 2015 (Annexure-4) of unauthorized Airlines Ticket selling by
one of its staff, respondent no. 4 and also using the official
accommodation. Petitioner has enclosed Air Tickets with his
representation containing the address of respondent no. 4 as contact
information to the customers.
Counsel for the petitioner has referred to office order dated
10th February, 2015 of Airport Director, Birsa Munda Airport, Ranchi and
also letter of Airports Authority of India dated 19th February, 2015 issued
by AGM (Engg/Civil-Commcl), whereunder the competent authority has
been advised to be vigilant in future and initiate strict action against the
errant officials/staffs, if found involved in any of the authorized business
and activities. According to the petitioner, the activities have continued
even thereafter as per Annexure-7 address pasted in a Linkedln site by the
same respondent using the Name and Logo of Airports Authority of India.
Petitioner has therefore approached this Court for a direction upon the
respondent nos. 1 and 2 to take appropriate action in this regard against
the concerned respondents.
Having considered the relevant material facts pleaded above by the
petitioner, at this stage, in the absence of respondent, this Court is not
inclined to make any comments on the merits of the contention of
petitioner. However, the writ petition is disposed of with a liberty to
petitioner to approach the Airport Director, Birsa Munda Airport, Ranchi
and pursue his grievances before him with all supporting facts and
documents also enclosing a copy of writ petition.
Needless to say due consideration be accorded by the competent
authority under the Airports Authority of India/ Airport Director, Birsa
Munda Airport, Ranchi in accordance with law, of course, after due notice
to the concerned parties within a reasonable time preferably 12 weeks.
Accordingly, writ petition stands disposed of.
