Bhanu Lodh vs Tripura Jute Mills Limited And Ors.

Heard Mr. BN Majumder, learned senior counsel assisted by Mr. R. Saha, learned counsel appearing for the appellant. Also heard Mr. D. Sarma, learned Addl. G.A appearing for the State-respondents and Mr. P. Gautam, learned counsel appearing for the respondents-Tripura Jute Mills Limited.

When the matter is called up, Mr. Majumder, learned senior counsel for the appellant has submitted that he has retired from this case and the appellant has already taken over the file from him. Today, the matter has been listed since it was kept as part-heard on 11.07.2024 with the expectation that it could be disposed of today, but knowing fully well that the case will be listed today, neither the appellant nor any of his representatives has appeared before this Court to seek adjournment. On last occasion, Mr. Majumder, learned senior counsel for the appellant sought for an adjournment to clarify certain positions of law. However, today he has informed this Court that he has retired from this case and the appellant had taken away the records from him, but today, as we said earlier, the appellant has not appeared.

In view of this, we have no other alternative, but to dismiss the case for non-prosecution.

Accordingly, the instant writ appeal stands dismissed for non-prosecution.
