Judgment
K.S. Jhaveri, J.—This petition is directed against the judgment and award dated 23rd November 2001 passed by Labour Court, Sabarkanta at Himmatnagar in Reference (LCH) No. 557 of 1996 whereby the said reference came to be rejected.
According to the petitioner, he was working as Work-charged wireman-cum-helper with respondent since 1982 and thereafter he had continuously worked upto the year 1993 and his services came to be illegally terminated. He therefore raised a dispute before the Labour Court by way of Reference (LCH) No. 557 of 1996 which came to be rejected against which the present petition has been filed.
Heard the learned Advocates for the respective parties and perused the relevant documents on record. As a result of this exercise I am of the view that the Labour Court has considered the matter in depth and discussed the evidence elaborately at pages 28 and 29. The finding of the Labour Court is that the petitioner was not on the pay role of the respondent and he was only a casual worker. On this finding the Labour Court arrived at a conclusion that there is no breach of the provisions of Section 25-F of the Act. Learned Advocate for the petitioner is not able to point out anything from the record to show that there was any violation of provisions of Section 25-F of the Act.
In the premises aforesaid, I do not find any merits in the matter. The petition is, therefore, dismissed. Rule is discharged with no order as to costs.
