The OA was disposed of by this Tribunal vide order dated 30.05.2023. Thereafter, the Contempt Petition came to be filed, and notices therein were issued on 29.05.2025. The respondents have now filed their compliance affidavit.

2.

Learned counsel for the petitioner submits that, in terms of the directions issued by the Tribunal, the respondents were required to re-fix the pay of the applicant with effect from 01.01.2005 and revise his pension as well as family pension. Furthermore, the respondents were also required to amend/correct the date of birth of the family pensioner/wife of the applicant. He submits that the aforesaid directions have not been fully complied with by the respondents. Although the respondents have re-fixed the pay, revised the calculations and placed the revised calculation sheet on record, the actual monetary benefits have not yet been released to the petitioner.

3.

Learned counsel for the respondents refers to the compliance affidavit and the Office Order dated 14.02.2025, whereby the pay of the applicant has been fixed with effect from 01.01.2005. He further refers to the order dated 15.01.2026, whereby the revised calculation consequent upon re-fixation of the pension/family pension has been carried out, as mentioned in the paper book. The date of birth of the family pensioner is mentioned as 29.05.1950, which is the correct date.

4.

We note that the pension has also been enhanced and necessary instructions for release of the consequential benefits would naturally have been issued. We are hopeful that the arrears arising out of the aforesaid revision of pension shall be released to the petitioner within a period of two months henceforth. To be absolutely clear, the arrears due to the petitioner shall be calculated with effect from 01.09.2023 till the actual date of payment. The arrears so calculated shall be released to the petitioner and the pension/family pension shall thereafter be paid at the enhanced rate, within a period of two months from the date of receipt of a certified copy of this order.

5.

With the aforesaid directions, the CP is closed. Notices are discharged. Pending MA, if any, also stands disposed of.
