The present writ petition has been filed under Article 226 of the Constitution of India seeking issuance of a writ in the nature of MANDAMUS directing the respondents to revise the salary of the petitioner after granting him the benefit of 3rd ACP from 01.10.2017 and accordingly release his salary with 16% interest and further directing the respondents to revise the pension of the petitioner and release arrears of retiral benefits as per revised salary alongwith interest.

Learned counsel for the petitioner submitted that the petitioner was entitled for the aforesaid benefits, which have been so mentioned in the head note of the present writ petition and in this regard, he had served a representation dated 17.04.2023 (Annexure P-6) to respondent No.2-Executive Engineer, Operation Division, DHBVN, Rewari, Haryana but the same has not been considered and decided till date. He further submitted that at this stage, the petitioner will be satisfied in case the aforesaid representation dated 17.04.2023 (Annexure P-6) is considered and decided by respondent No.2-Executive Engineer, Operation Division, DHBVN, Rewari, Haryana in accordance with law and in a time bound manner.

Notice of motion.

On the asking of the Court, Mr. Samarth Sagar, Addl. A.G., Haryana, accepts notice on behalf of all the respondents. He submitted that in view of the limited prayer made by learned counsel for the petitioner, he has no objection in case time bound direction is issued in this regard.

In view of the aforesaid facts and circumstances, without calling for the reply from the respondents and without expressing anything on the merits of the case, the present writ petition is disposed of with a direction to respondent No.2-Executive Engineer, Operation Division, DHBVN, Rewari, Haryana to consider and decide the representation dated 17.04.2023 (Annexure P-6) strictly in accordance with law and within a period of three months from today.
