Hon’ble Dr Anand S Khati, Member (A):

MA No.4080/2026 (joining together)

1.

The present MA has been filed by 38 applicants seeking permission fo this Tribunal to file the OA jointly.

2.

In view of averments made in the MA, MA No. 4080/20026 is allowed.

OA No. 3175/2026

1.

The applicants have filed the present Original Application seeking regularization of their services and grant of consequential benefits. They were engaged as Casual Workers/Daily Wagers on Muster Roll in different offices under the Income Tax Department and claim to have rendered continuous service for approximately 18 to 26 years while discharging duties of a perennial nature.

2.

The applicants contend that despite their long service, they have neither been granted temporary status nor regularized, whereas similarly situated casual workers in different offices of the Income Tax Department have been granted such benefits pursuant to Government instructions and judicial pronouncements.

3.

Learned counsel for the applicants submits that the claims of the applicants deserve consideration in the light of the Office Memorandum dated 11.12.2006 issued by the Department of Personnel and Training in terms of Uma Devi, the instructions issued by the Central Board of Direct Taxes, and the judgments of the Hon’ble Supreme Court, including Secretary, State of Karnataka v. Uma Devi (3), Raman Kumar v. Union of India and Pawan Kumar & Others v. Union of India. Reliance has also been placed upon the orders passed in the cases of similarly situated employees by this Tribunal and other constitutional courts.

4.

It is further submitted that the applicants submitted representations dated 28.04.2026 and 26.05.2026, requesting the respondents to consider their claims for regularization in the light of the aforesaid judgments and the benefits extended to similarly situated employees. However, no decision has been communicated to them till date. Aggrieved by the inaction of the respondents, the applicants have approached this Tribunal.

5.

At this stage, learned counsel for the applicants submits that he will be satisfied if a direction may be issued to the respondents to decide the pending representations of the applicants.

6.

In view of limited prayer made by learned counsel for the applicants, and without expressing any opinion on the merits of the case, we deem it appropriate to dispose of the present Original Application with a direction to the competent authority amongst the respondents to consider and decide the applicants’ representations dated 28.04.2026 and 26.05.2026, by passing a reasoned and speaking order within six weeks from the date of receipt of a certified copy of this order.

7.

It is clarified that this Tribunal has not expressed any opinion on the merits of the case.

8.

The Original Application stands disposed of in the above terms. There shall be no order as to costs.
