Heard both the sides.
This bail application filed on behalf of Basant Tiwari who is in custody since 08.10.2025 in connection with Namkom P.S. Case No. 188 of 2025 for the offence registered under Sections 126(2), 115(2), 316(2), 318(4), 352, 351(2) & (3), 61(2) of the BNS pending in the Court of J.M, Ranchi is pressed into motion. As per the FIR lodged by one Kiran Devi, Khushi Tiwari had duped her husband of Rs.11,20,000/- by entangling him in a love-affair. Khushi Tiwari is a married lady with one child. The money was extorted on a threat of making viral the obscene posts of her husband.
It is argued by the learned counsel on behalf of the petitioner that he happens to be father of the accused person- Khushi Tiwari and has been roped into the case to exert pressure on the petitioner. It is also argued that it is counter blast to Gonda P.S. Case No. 64 of 2025 lodged on 28.05.2025 under Sections 77, 79, 82(2), 82(1), 61(2), 351(3), 352 of the BNS and Sections 67(A), 66(D) of the IT Act, by Khushi Tiwari against Kashinath Nayak who happens to be the husband of the informant in the present case.
Learned A.P.P. for the State assisted by the counsel on behalf of the informant have vehemently opposed the prayer for bail and submitted that petitioner has criminal antecedent of similar nature and the amount has been received through bank transaction by the accused persons.
Having considered the submissions advanced, it appears that the present case is a counter blast to earlier case filed by the daughter of this petitioner and FIR does not disclose or state that said amount was credited in the account of this petitioner. Allegation is mainly directed against the daughter of this Petitioner.
Under the circumstances, the above-named petitioner is directed to be released on bail on furnishing bail bond of Rs.25,000/-(Twenty-Five Thousand) with two sureties of the like amount each to the satisfaction of the Court below.
