When the case is called none appears for the petitioner. On earlier occasions also i.e. 08.02.2022 counsel for the petitioner was not present before this Court. Mr. A. Roy Barman, learned counsel for the respondent is present and Mr. R. Datta, learned P.P. is also present.

Mr. Roy Barman, learned counsel appearing for the respondent No.2 submits before this Court upon instruction that Mr. Ashok Kr. Saha has not been arrested and the question of filing this bail application does not arise accordingly, the same is not maintainable.

It needs to be presumed that continuous absence of the counsel for the petitioner in this present bail application and the representation made by the counsel appearing for the Enforcement Directorate if read together, it would be evident that counsel for the petitioner is not interested to pursue with the litigation for whatsoever the reason.

In view of the above, the present bail application stands dismissed for non-prosecution. A copy of this order be furnished to the counsel appearing for the parties.
