Heard the learned counsel for the petitioners and the learned counsel for the State. It reveals from the written report that son of the informant was tortured by his wife and in laws and due to that he committed suicide.
It is submitted that the informant was all along present at the time of cremation, but he never raised any such allegation at that point of time. After lapse of two months, this case has been lodged. No suicidal note was left by him. Two of the accused have been granted bail by this Hon''ble Court vide ABA No. 2197 of 2012.
Learned counsel for the State has opposed the prayer.
It appears that the deceased was not happy with his family life, but no direct evidence with regard to abetment to commit suicide has come in the case diary against the petitioner. Considering above facts and circumstances of the case, the petitioner above named is directed to appear/ surrender before the court below within a period of three weeks positively from the date of this order and on his surrender, he shall be released on bail on furnishing bail bond of Rs. 10,000/- (rupees ten thousand) with two sureties of the like amount each to the satisfaction of CJM Deoghar in connection with Mohanpur P.S. case No. 83 of 2011 (GR No. 318 of 2011), subject to the conditions laid down u/s 438(2) Cr.P.C.
