Judgment
The matter was taken up today through Video Conferencing at 11:50 AM. Heard Sh. Vipin Kumar Kushwaha, Advocate for the Applicant and Ms. Babita Jain, Advocate for the Bank of India through video conferecing through video conferencing.
The present IA No. 224/2020 in CP No. (IB) 80/ALD/2019 has been filed by the Applicant under Section 12A of the Insolvency & Backruptcy Code, 2016 for withdrawal of the CIR Process on the ground that the Committee of Creditors has approved the said withdrawal in its 7th Meeting held on 08.09.2020 by 100% voting shares.
After hearing the learned Counsel for the Applicant, this Court of the opinion that as the Committee of Creditors has approved the Resolution for withdrawal of the CIR Process by 100% voting shares, the same is dismissed as withdrawn, no order as to cost.
The IA No. 224/2020 accordingly disposed of.
