Judgment
The matter was taken up today through Video Conferencing at 12:30 PM.
Heard Sh. Ankit Shukla, Advocate for the Applicant and Sh. Abhinav Gaur, Advocate for the Financial Creditor, who are present through video conferencing.
The present application being IA No.191/2020 in CP No.(IB)515/ALD/2019 has been filed by the Applicant/Petitioner under Section 12A of the IBC, 2016 read with Regulation 30A of Insolvency & Bankruptcy Board of India (Insolvency Resolution Process for Corporate Persons) Regulation, 2016 for seeking withdrawal of Corporate Insolvency Resolution Process against M/s Hint Publication Pvt Ltd (Corporate Debtor).
Learned counsel for the Applicant/Petitioner contended that the CoC in its Board Meeting dated 10.08.2020 has passed the Resolution for withdrawal of the present petition Under Section 7 of the IBC with 100 % voting share and therefore, the present application is being filed for withdrawal of the CIRP.
In view of the submissions made by the learned counsel for the Applicant/Petitioner and in view of the Resolution of the CoC dated 10.08.2020 passed by 100% voting share, the present Petition is dismissed as withdrawn.
No order as to cost.
