Judgment
Counsel appearing for the petitioner submitted that this appeal has been preferred against the tariff orders passed by the respondent no. 1 for the third control period. It is further submitted by the counsel for the appellant that for the first and second control period Tariffs, the Tariff periods orders are under challenge and the matters are pending before the Hon’ble the Supreme Court. It is further submitted by the counsel for the appellant that some of the issues involved in this AERA Appeal are also pending before Hon’ble Supreme Court. The matters in Hon’ble the Supreme Court have been further listed for hearing on 14.2.2023. Hence, it is submitted by the counsel for the appellant that this matter be adjourned after 14.2.2023.
Having heard the counsels of both the sides and looking to the facts and circumstances of the case and as some of the issues involved in this AERA Appeal are also issues pending before Hon’ble the Supreme Court wherein Tariff order passed by the respondent 1 for the first and second control period are under challenge, and, hence this matter is adjourned to 24.5.2023.
