The petitioner seeks regular bail in case FIR No.102 dated 10.09.2017, registered at Police Station Sadar Nabha, District Patiala, under Sections

22/61/85 of NDPS Act, 1985.

Learned counsel for the petitioner submits that the petitioner has been framed in this case. He is a school teacher and was sitting in the shop of the

co-accused when it was raided. Since, the petitioner objected, he was also framed. It is further submitted that the petitioner has been in custody

since 10.09.2017 and investigation is complete. The trial of the case may take some time and therefore, the petitioner is entitled to grant of regular

bail. He has also placed reliance on order dated 23.02.2018 passed in CRM-M-2251-2018, whereby co-accused, namely, Komal Bansal has been

granted regular bail.

On the other hand, learned State counsel submits that a heavy quantity of narcotic substance has been recovered from the petitioner and therefore,

he does not deserve the concession of regular bail. However, it is not in dispute that the petitioner is a school teacher and that co-accused, namely,

Komal Bansal has been granted regular bail.

Keeping in view the totality of the facts and circumstances of this case and on the principle of parity, I deem it appropriate to allow this petition.

Accordingly, the petition is allowed and petitioner-Baljinder Singh is ordered to be released on bail on his furnishing bail and surety bonds to the

satisfaction of the trial Court concerned.
