Baleshwar Ram vs Chancellor, Magadh University and Others

S.J. Mukhopadhaya, J.—In this case, prayer has been made to direct the Respondents to accommodate the Petitioner to the post of Lab. Boy against which he was appointed on 29th April, 1982.

According to the Petitioner, in pursuance of one advertisement dated 10th July, 1981, the Petitioner, on selection, was appointed to the aforesaid post vide order dated 26th April, 1982. His appointment was made in one M.D. College, Buxar. The College was under the then Magadh University which issued one order on 2nd June, 1984 terminating the services of Petitioner and others on the ground that their appointments were made in violation of Section 35(2) of the Bihar State Universities Act, 1976.

It is stated that now the College has been placed under Veer Kuer Singh University and this Court in similarly situated cases have already granted relief.

In the counter affidavit filed on behalf of the Respondent-University, it is stated that the services of the Petitioners were terminated in the year 1984. They have also enclosed a copy of the Court''s order dated 30th July, 1997, passed in C.W.J.C. No. 2278 of 1997 Smt. Bimla Devi and Others Vs. Loknath Bishwanath, . In the said case, this Court rejected the prayer to entertain the matter on the ground of inordinate delay, the party having moved after about fifteen years.

The case of the Petitioner being covered by the aforesaid decision of this Court in the case of Shiv Kumar Ram (supra), I also dismiss the present writ petition.

The writ petition is accordingly, dismissed.
