The petitioner through instant petition under Articles 226/227 of the Constitution of India is seeking direction to respondents to absorb him as Constable or Civil Clerk since he is working as SPO in the Office of SSP, Patiala.
The petitioner was enlisted as Punjab Home Guard (for short ‘PHG’) in 1989. In a terrorist attack, he suffered injuries resulting in physical disability to the extent of 40%. On sympathetic ground, the respondent absorbed him as Special Police Officer from 01.06.1992.
In view of judgment of this Court in CWP No. 7451 of 1996 titled as ‘Lal Mohd. and others vs. State of Punjab’, the petitioner was time to time considered for the post of Constable. He, by extending relaxed eligibility criterias, was appointed as Clerk w.e.f. 25.09.2006. He was further promoted to the post of Senior Assistant vide order dated 17.05.2021 passed by DGP, Punjab.
Learned State counsel submits that service rendered by petitioner as SPO has been counted for the purpose of qualifying service for pensionary benefits.
In the wake of statement of learned State counsel, nothing survives, accordingly, the present petition stands disposed of.
The petitioner is at liberty to move an appropriate application, if cause survives.
Pending misc. application(s), if any, shall also stand disposed of.
