The petitioner No.2 herein is arraigned as accused No.3 in Crime No.85 of 2024 of Adoni III Town Police Station for the offence under Sections 74, 332(b), 351(2) of BNS and Section 8 of POCSO Act 2012.

The De facto complainant is the mother of the victim aged 17 years and it is alleged in the complaint that her daughter was found missing and the complaint was lodged in Adoni III Town Police Station. The De facto complainant and her husband came to know that her daughter was kidnapped by Accused No.1 and she was taken to Hyderabad where Accused No.3 along with his wife (Accused No.2) was staying.

As seen from the complaint the petitioner No.2 and his wife felicitated the performance of the marriage of the victim girl with Accused No.1.

The learned counsel for the petitioners submits that the marriage took place at the instance of the victim girl and Accused No.1 and that Accused No.1 is the brother of Accused No.2. As such, petitioner No.2 got involved in pursuance of the said marriage.

It is also submitted that during the pendency of the bail application, petitioner No.1 (Accused No.2) was apprehended by the police.

The learned Assistant Public Prosecutor submits that the petitioners were aware of the harassment meted out by Accused No.1 to the victim girl and that they have given shelter to the victim girl and Accused No.1. It is submitted that Accused Nos.1 and 2 are released on bail.

The learned Assistant Public Prosecutor submits that the charge sheet is yet to be filed.

Considering the same, this Court is inclined to grant bail with the following conditions:-

i.The petitioner No.2/Accused No.3 shall be enlarged on bail in the event of arrest on he executing a personal bond for Rs.10,000/- (Rupees Ten Thousand only) with two sureties for a like sum each to the satisfaction of the Adoni III Town Police Station.

ii. The petitioner No.2/Accused No.3 shall co-operate with the investigation and attend before the investigating officer as and when required.

With the above conditions, the criminal petition is allowed.

Miscellaneous petitions, if any pending, in the Criminal Petition, shall stand closed.
