O R D E R
Heard both of them.
Shri Thakur submits that the applicants have been working as Casual Workers with the respondents from 2008 and as per SRO 520 of 2017 their names and other details were required to be uploaded in NIC Portal. This could not be done as only a short period of time was available for the applicants. They have submitted a representation dated 21.2.2022 for uploading their names and other details in the NIC Portal and regularize them in service.
M.A. No. 61/343/2022 filed by the applicants for submitting this O.A. jointly is allowed
However, Shri Hunar Gupta submits that since the details of the applicants were not uploaded on NIC Portal as per SRO 520 of 2017, they have not been engaged by the respondents from that time and from 2017 onwards till 21.2.2022 the applicants had not worked with the respondents. But if directe, the respondents may consider the pending representation of the applicant.
On consideration of the above submissions, this O.A. is disposed of at admission stage, without expressing any opinion on merits of the case, directing the respondents to consider the pending representation of the applicants dated 21.2.2022, if the applicants have been continuously engaged as Casual Workers and they are entitled for uploading for the details in NIC Portal and if they are entitled for this as per provisions of relevant rules and binding instructions and decide it with a reasoned and speaking order within six weeks from the date of receipt of a copy of this order and thereafter within one week communicate it to the applicant.
