This application has been filed by the applicant seeking further direction in the matter which was disposed of on 18.07.2022. Thereby, the Tribunal dealt with the grievance against illegal cutting of trees in 2018 at Makrana to Maglana Road in District Nagore, Rajasthan and incident of 2021 when trees were cut near Bus Stand Makrana and Ghati Choraha near Masjid.

The Tribunal passed the order on consideration of report dated 13.07.2022 of joint Committee of Divisional Forest Officer, Nagore and District Magistrate, Nagore that remedial action had been taken.

According to the applicant, action still needs to be taken. In the MA under consideration, it is stated as follows:-

“It is to inform your good self that we have also planted Neem trees in 2003 on both side in 20 Kms length road from Makrana to Maglana road in district Nagore (Rajasthan) with the permission of District collector Nagore (Letter attached at Annexure - A) but in 2018 a person has illegally cut two plants and after that we have given a written complaint to SDM Makrana (copy attached at Annexure — B) but no fruitful result was obtained till date. Snaps & news related to this incident is attached at Annexure — C & C 1.

Again in 2021 an illegal incident of cutting of trees planted by us has occurred near bus stand of Makrana and one in Ghati Choraha near Masjid and one of our committee member call on toll free No. 181 for complaint and a person from forest department have came to inspect the incident but no result was obtained. (Report attached at Annexure — D)

You are requested to please look in this matter for legal action as for plantation of trees a lot of efforts and resources have to be deployed and is great damage to nature.”

In view of above, without expressing any opinion on merits, we consider it appropriate to direct the Divisional Forest Officer, Nagore to further verify the facts and take remedial action, associating the applicant. The action may include plantation of trees in forest/non-forest areas and their protection as per the Rules/Regulations, involving communities like the present one.

The application is disposed of.
