Judgment
Vipin Sanghi, CJ
1) Issue notice.
Counsel appears and accepts notice on behalf of respondent Nos. 1 to 3.
2) The petitioner has preferred the present petition to seek protection and security over his business premises / liquor vend at Haridwar Bypass, near Rispana Bridge, Dehradun, and to provide protection to the sales manager / sales persons, and other employees of the petitioner, operating the said business in the said premises.
3) Petitioner submits that the liquor shop in the area in question was earlier being operated at the premises of which respondent No. 4 is the landlord. Respondent Nos. 5, 6, 7 and 8 are the local persons in the area, where the petitioner intends to set up the liquor vend. The petitioner claims that respondent Nos. 4 to 8 are threatening the petitioner and his employees, and are creating hindrance in the setting up of the liquor shop by the petitioner.
4) The petitioner is entitled to carry on his business in a legal way in the area which is approved by the excise department.
5) We dispose of this petition with a direction to respondent Nos. 2 and 3 to examine the position, and assess the threat perceived by the petitioner and his employees, and to provide protection to the petitioner to the extent considered necessary.
6) It is, however, made clear that this order shall not be used by the petitioner for any other purpose whatsoever, and no authority shall be influenced by this order, while passing any order, in so far as, the petitioner’s liquor vend is concerned. This order shall also not come in the way of the local residents, including the respondent Nos. 5 to 8 in raising their grievance, if any, against the liquor vend set up by the petitioner.
7) Petition stands disposed of in the aforesaid terms.
8) Urgent copy of this order be supplied to the learned counsel for the parties, during the course of the day, as per Rules.
