Judgment
Ravindra Maithani, J
Applicant Avneesh @ Ashvani is in judicial custody in FIR No.0082 of 2023, under Section 2(b)/3 of the U.P. Gangsters and Anti Social Activities (Prevention) Act, 1986, Police Station- Kankhal, District- Haridwar. He has sought his release on bail.
Heard learned counsel for the parties and perused the record.
According to the FIR, the applicant is a member of a Gang. They were involved in paper leak of public examinations.
Learned counsel for the applicant would submit that based on one case, the applicant has been involved in the matter, but the applicant has already been granted bail in the earlier case; he has no other criminal history.
Learned State Counsel admits these facts.
Having considered, this Court is of the view that it is a case fit for bail and the applicant deserves to be enlarged on bail.
The bail application is allowed.
Let the applicant be released on bail, on his executing a personal bond and furnishing two reliable sureties, each of the like amount, to the satisfaction of the court concerned.
