It appears from the soft copies of the relevant documents, filed by the parties, that copies of these applications have been served on the opposite parties. However, none appears for the opposite parties when the matter is taken up via video conferencing.
CAN 3026 of 2020 has been filed for taking up the application for extension of interim order on the ground of urgency that the interim order extended lastly till April 30, 2020 would expire and it is extremely difficult for the advocates and litigants to attend court due to the ongoing COVID-19 scare.
On being satisfied regarding such urgency, CAN 3026 of 2020 is allowed without any order as to costs.
Re: CAN 3027 of 2020 (extension of interim order)
CAN 3027 of 2020 has been filed by the petitioner for extension of the interim order, originally granted by a co-ordinate Bench of this Court on August 4, 2011, and thereafter extended from time to time.
Learned counsel for the petitioner submits that the petitioner has already filed a supplementary affidavit, showing due compliance by the petitioner, of the conditions imposed by different co-ordinate Benches from time to time for grant and extension of the status quo order.
As such, in view of the petitioner having complied with the conditions of stay as stipulated earlier, and in view of the extreme urgency made out, the interim order dated August 4, 2011, directing status quo to be maintained by both parties in respect of the property-in-dispute, shall stand extended till September 30, 2020 or until further order, whichever is earlier.
It is made clear that such extension is conditional upon the petitioner going on complying with the previous direction for monthly payment, as condition for the status quo.
It is made clear that the petitioner shall file a regular hard copy of an affidavit-of-service within a week from the reopening of court upon resumption of normal work after the COVID-19 lockdown is over, to satisfy the court of the proper service of the applications, taken up for hearing today, on the opposite parties.
CAN 3027 of 2020 is accordingly disposed of, with liberty to the petitioner to pray for extension of the interim order, if necessary, on the revisional application itself.
There will be no order as to costs.
Liberty is also granted to both sides to mention the main matter before the regular Bench upon resumption of functioning of this court, after the lockdown due to the COVID 19 pandemic is over.
Urgent photostat certified copies of this order, if applied for, be made available to the parties upon compliance with the requisite formalities.
