The District President/convener and other office bearers of Chhattisgarhiya Kranti Sena have sent to this Tribunal by post copy of letter petition, addressed to His Excellency President of India, which is treated and registered as original application.

The applicants have complained about cutting of hundreds of trees ruthlessly in high dense Hansdeo forest spread over hundreds of kilometers for favoring private mining companies for mining of coal from the reserves buried below the forest. Mining of coal in the dense forest will damage bio-diversity, ecosystem, flora and fauna of the forest, endanger wildlife and uproot the forest dwellers and destroy the source of their livelihood. The applicants have requested to stoppage of such mining project warning that the Chhattisgarhiya Kranti Sena and inhabitants of Chhattisgarh will strongly oppose mining projects even at the cost of their lives.

We have been informed that Civil Appeal No. 4395 of 2014 titiled as Rajasthan Rajya Vidyut Utpadan Nigam Limited Vs. Sudiep Shrivastava and others, filed against Judgment dated 24.03.2014 passed by this Tribunal in Appeal No. 73/2012 quashing order dated 23.06.2011 of the Minister of Environment of Forest and the forest clearance dated 28.03.2012 granted to the Parsa East Kete Basan (Herein after referred as PEKB) Coal Block by the State of Chhattisgarh, is pending before Hon’ble Supreme Court.

Appeals No. 185/2018, 12/2019 and 16/2019 challenging grant of environmental clearance to mining projects in the State of Chhattisgarh including parts of Hansdeo Forests have been filed before this Tribunal.

In view of the pendency of the Civil Appeal No 4395/2014 before Hon’ble Supreme Court, the above said appeals filed before this Tribunal were ordered to be listed after decision of the Hon’ble Supreme Court.

In view of the pendency of above said appeals before Hon’ble Supreme Court and this Tribunal, we are of the considered view that no intervention by this Tribunal is warranted on the present application as the matter will abide by the decisions of the above said appeals.

The application is disposed of accordingly.
