Judgment
Mr. L. Ram Singh, learned counsel for the petitioner.
Mr. Tandra Ramesh, learned Assistant Government Pleader for Medical, Health and Family Welfare Department appears for respondent No.1.
Mr. T.Sharath, learned Standing Counsel for Kaloji Narayana Rao University of Health Sciences (hereinafter referred to as 'the University'), appears for respondent No.2.
The present writ petition is filed with the following prayer:
"…to issue an appropriate writ order or direction more particularly one in the nature of writ of Mandamus declaring the action of the Respondent No.2 in listing the petitioner in ineligible list in MBBS/BDS Courses under Competent Authority Quota (A-Category) for the Academic Year 2026-27 as arbitrary, illegal, unconstitutional and violative of Articles 14, 21A of the Constitution of India and consequently direct the respondent No.2 to accept and upload the X Class Memorandum of marks certificate of the petitioner containing the date of birth and permit her to opt for WEB options for Competent Authority Quota (A Category) for next phase of counseling for the academic year 2026-27 and be pleased to pass…."
Petitioner had appeared for NEET (UG) 2026 examination and secured All India Rank of 250516. The respondent University has issued notification dated 04.08.2026 inviting online applications for admission into MBBS/BDS courses for the academic year 2026-27. The petitioner applied under 'A' category and her application was successfully registered. However, in the merit list, which was issued on 24.08.2026, the name of the petitioner has not been included. The petitioner made an enquiry and thereupon learnt that inadvertently she has not annexed her 10th Class marks memo in proof of her date of birth. Therefore, her name has been included in the list of ineligible candidates. On coming to know about the same, immediately, the petitioner addressed a mail to the respondents on 31.08.2026 to receive and upload her 10th Class marks memo. But, no action has been taken by the respondents. Hence, the petitioner approached this Court.
Learned Standing Counsel for the University submits that in the event the University permits exercise of web options, the representation of the petitioner dated 31.08.2026 shall be considered on its own merits.
In view of the aforesaid submission and in the peculiar facts of the case, the petitioner's representation dated 31.08.2026, be considered on its own merits in accordance with law within a week.
The instant Writ Petition is, accordingly, disposed of. There shall be no order as to costs.
As a sequel, miscellaneous petitions, pending if any, stand closed.
