Judgment
Counsels appearing for both the sides submitted that the interim order passed by this Tribunal dated 13.4.2023 was challenged before Hon’ble The High Court of Kerala in WP(C) No.15074/2023 where an order has been passed by Hon’ble High Court of Kerala that the petitioner who is respondent in the present Broadcasting Petition, has to deposit Rs.30 Lakhs before the Registrar of this Tribunal and for remaining amount, out of admitted amount by the present respondent in 15 equal installments have been granted.
It is submitted by the counsel for the respondent that they have already deposited Rs.30 Lakhs before this Tribunal. In view of the order passed by the Hon’ble High Court of Kerala in WP(C) no.15074/2023 dated 15.6.2023, especially as per paragraph no.5 (III) it is submitted by the counsel for the petitioner that this amount of Rs.30 Lakhs may be given to this petitioner.
In view of the order passed by the Hon’ble High Court of Kerala as stated hereinabove a photocopy whereof is tendered to this Tribunal and taken on record, Registrar of this Tribunal is directed to return Rs.30 Lakhs along with accrued interest to the petitioner. This amount shall be paid by way of Cheque to the petitioner.
M.A No.132/2023: preferred by the present respondent, is hereby disposed of.
Respondent is permitted to file reply in Broadcasting Petition as well as in M.A No.469/2022 by next date of hearing.
Hence, this matter is adjourned to 8.8.2023.
