The applicant has filed the present OA under Section 19 of the AT Act, 1985 on being aggrieved by the inaction of the respondents in not visiting
the penalty imposed upon him after his acquittal in the criminal case, in view of the provisions of Rule 12 of Delhi Police (Punishment and Appeal)
Rules, 1980, in spite of his representation dated 27.11.2019 (Annexure A-1).
Heard.
Issue notice to the respondents. Shri Amit Yadav for Ms. Esha Mazumdar, learned counsel, who appears for respondents on advance service,
accepts notice.
Shri Gill, learned counsel for the applicant, at this stage, submits that the applicant will be satisfied, if the present OA is disposed of with direction to
the respondents to consider the applicant’s aforesaid representation dated 27.11.2019 (Annexure A-1) in a time bound manner.
We are of the considered view that if such request of the applicant is accepted, no prejudice is likely to be caused to the respondents.
In view of the aforesaid, without going into the merits of the claim of the applicant, the present OA is disposed of with direction to the respondents
to consider the applicant’s aforesaid representation dated 27.11.2019 (Annexure A-1) and to dispose of the same by passing a reasoned and
speaking order as expeditiously as possible and in any case within 8 weeks from the date of receipt of a copy of this order.
The OA is disposed of, in the aforesaid terms. No order as to costs.
