The petitioner has invoked the extraordinary jurisdiction of this Court, seeking a direction for speedy trial of the proceedings pending before the learned Principal Family Court, Jammu (hereinafter referred to as, “the trial Court”) under Section 13 of the Hindu Marriage Act in case titled, “Ashwani Kumar Sharma Vs. Rachna Sharma”. A report was called for, from the trial Court. Perusal whereof reveals that, initially, the petitioner had changed the services of the counsels, which resulted in various adjournments and now the matter is pending at the stage of recording of the evidence. Even otherwise, there is a constitutional mandate to have a speedy trial. However, keeping in view the mounting pendency, it is for the learned trial Court to regulate its proceedings. Nonetheless, it is expected that the trial Court shall wrap up the proceedings expeditiously, provided that there is no lackadaisical approach on the part of the parties.

Writ petition is, accordingly, disposed of alongwith connected application.
