Ashwani Kumar vs The State of H.P. and another

Justice Sanjay Karol, J.—Petitioner was initially engaged on contract basis as a lecturer (Public Administration) in Government Senior Secondary School, Jawali (Kangra). There, he worked from 11.3.1996 up to 21.5.1998 when a regularly appointed replaced him. Subsequently, petitioner was re-engaged in the very same institution, on contract basis w.e.f 11.9.1998, but, as lecturer, Political Science. It is not in dispute that petitioner now stands regularized. It is, however, his grievance that period between 22nd of May, 1998 and 10th of September, 1998 has not taken into account for the purpose of considering his case for regularization.

According to learned counsel for the petitioner, the matter in issue is squarely covered by judgments delivered by this Court in CWP No. 1689/2010 titled as Darshan Singh Vs. State of H.P and CWP(T)5228/2008 titled as Prem Lal Vs. State.

Mr. Vinod Thakur, Learned Dy. A.G for the respondents has invited my attention to the effect that Judgment dated 21.4.2010 in Prem Lal (supra), is subject matter of challenge in LPA No.175 of 2010. As such, it is stated that the Judgment in Prem Lal (supra) has not attained finality.

The present petition can be disposed of with the direction that decision in LPA No. 175 of 2010 upon attaining finality, shall be made applicable to the petitioner also. The present petition is thus disposed off.
