Judgment
This petition by a lawyer practising at the Patna High Court, calling himself a social worker, submits that the courses in the M.B.B.S. Part-I examination having been completed and after that the examination also having been conducted but the results are not being published. It is also submitted that the M.B.B.S. Part-ll examination be scheduled during November 2002 after completion of the supplementary examination of the M.B.B.S. Part-I.
That the schedules of academic courses are not being adhered to, perhaps, may be a reality. But, the Court does not consider it appropriate that without knowing the causes of academic schedules falling behind, the High Court should be taking upon itself a responsibility, which it may not be able to keep.
Truly under the law (the Bihar State Universities Act, 1976.) the head of higher studies, which the Universities are, is the learned Chancellor. Yet for another reason the High Court feels that it should not interfere in a matter which can be placed with greater details before the learned Chancellor. The learned Chancellor is otherwise equipped and has been vested with sufficient powers to examine the causes as to why academic courses may not be running on schedule.
In the circumstances, this matter should be addressed to the rightful quarters as obseryed in this order.
