Judgment

Learned counsel for the parties are present.
This writ petition has been filed for the following reliefs:-
“For issuance of direction commanding upon the respondents for compliance of Service order Part I No. 28/11 dated 01.02.11 whereby the petitioner has been declared fit for promotion cum posting to the rank of ASI/Exe by the respondents although the juniors to the petitioner have been given.
Promotion-cum-posting to the rank of ASI/Exe whereas the petitioners case has been left out to the reasons best known to the respondents which is grossly illegal and violative of article 14 and 16 of the constitution of India.”
Learned counsel appearing on behalf of the petitioner Mr. Arun Kumar on instruction of Advocate on record Mr. Jitendra Tripathy, submits that the present writ petition has become infructuous and therefore he does not want to press the same.
Learned counsel for the respondents has no objection to the prayer made.
Accordingly, this writ petition is dismissed as not pressed.
Pending I.A., if any, is closed.
