Ashok Kumar vs The State of Haryana and others

Alok Singh, J.—Present petition is filed by the petitioner seeking protection of his life and liberty from respondents No. 6 to 14.

Petitioner is present in person before this Court along with his counsel, Mr. H.K. Aurora, Advocate. On being examined, petitioner has stated that he is in business of supplying labour to the brick-kiln owners; some of the labour supplied by the petitioner has fled away from the brick-kiln, therefore, brick-kiln owners are pressurizing him either to arrange the labour or to accompany them to their brick-kiln.

Learned counsel for the petitioner has vehemently argued that petitioner has moved representation to the authorities against the threats being given by the brick-kiln owners, however, no action is being taken thereon.

On being asked, as to whether any FIR has been lodged against the brick-kiln owners complaining that petitioner is receiving life threats u/s 506 IPC, learned counsel states that no specific FIR has been lodged, however, representation/application was moved.

Petitioner has efficacious remedy either to lodge FIR directly to the police or to move an application u/s 156(3) Cr.P.C. before the competent Magistrate requesting the Court to direct the police to register FIR and to investigate the matter.

In view of this, I am not inclined to entertain this petition.
