Heard Mr. Bharat Kumar, the learned counsel for the petitioner, Mr. Arup Kumar Dey, the learned counsel for the respondent State and Mr. Shashank Shekhar Prasad, the learned counsel appearing on behalf of the O.P.No.2.
This petition has been filed for quashing of the entire criminal proceeding in connection with Daltonganj Sahar P.S. Case No.284 of 2017, corresponding to G.R. No.2015 of 2017, pending in the court of learned Chief Judicial Magistrate, Palamau at Daltonganj.
Mr. Bharat Kumar, the learned counsel for the petitioner submits that the present case has already been quashed by this Court in Cr.M.P. No.2936 of 2017 in the case filed by one of the accused who is the officer of the said company by order dated 04.07.2023.
The learned counsel for the O.P.No.2 as well as the respondent State also accept the said submission.
It appears that by order dated 04.07.2023 passed in Cr.M.P. No.2936 of 2017, the entire criminal proceeding has been quashed and that order is not restricted to the petitioner of that case only.
In view of that the case of the petitioner will govern in view of the judgment dated 04.07.2023 passed in Cr.M.P. No.2936 of 2017.
This petition is accordingly disposed of.
