Judgment

Through the instant writ petition filed under Article 226/227 of the Constitution of India, the petitioners have approached this Court, seeking quashing of a speaking order dated 24.11.2025 (Annexure P-2), wherethrough, their claim for grant of Annual Career Progression (ACP), was not considered on the ground that the finance department has to issue fresh instructions for the purpose of fixing the ACP.
This Court vide order dated 08.01.2026, had passed the hereinafter extracted direction:-
“Before this Court takes a congnizance of the grievance as raised through the instant writ petition, let learned State counsel have instructions, as to how much time is required to issue new ACP guidelines, which form the basis for not deciding the representation as preferred by the petitioner.
Adjourned to 22.01.2026.”
In deference to the aforesaid direction, today, learned State counsel, after having instructions from the Secretary concerned, informs this Court that the new instructions with regard to ACP will be issued within a period of three months from today.
In view of the above, the instant petition, is disposed of, with a liberty to the petitioners to file a fresh representation before the authority concerned, post the issuance of new instructions.
In case such representation is filed by the petitioners, a positive MANDAMUS is passed upon the competent authority concerned, to decide the issue/representation, afresh.
