Both the applications arose from same First Information Report, therefore, are heard together and disposed of by this order.
It is submitted on behalf of the petitioners that from the allegations made in the First Information Report, no offence made out, hence, the impugned order is a mis-use of process of law.
Having heard learned counsels for the parties, I have gone through the record of the case. From perusal of paragraph nos. 9 and 10 of the application, I find that there is allegation against the petitioners that they in league with one Shankar Yadav had forged the signature of complainant and got the truck transferred in the name of Shankar Yadav.
From perusal of Annesure-2, charge-sheet, I find that after investigation police found that the said allegations are true. Thus prima facie offences as enumerated in the impugned order are made out.
Under the said circumstances, I do not find any merit in these applications. Accordingly, both the applications are dismissed.
