Judgment
Rakesh Ranjan Prasad, J.—Order dated 04/06/2012, whereby summon has been issued against the petitioners for facing trial for the offence punishable under Sections 148, 352, 323, 380, 354, 504, I.P.C., is being sought to be quashed on the ground that on such allegation an F.I.R. had been lodged but the police did not find allegation to be true and, hence, final form was submitted and also on the ground that there has been property dispute in between the parties. So far as the first ground, taken for assailing the impugned order, is concerned, that never appears to be tenable. It may be that the police did not find the allegation to be true but the Court has taken cognizance of the offences on the materials brought during inquiry, and that so far other ground is concerned, that may be relevant for the purpose of trial and may not be material for the purpose of quashing of the order taking cognizance.
Accordingly, I do not find any illegality with the order taking cognizance and, hence, this application stands dismissed.
