This writ petition has been filed praying for a writ of Mandamus directing the Respondents 2 and 4 to restrain the 6th Respondent from destroying and altering the idols, stone inscriptions, pillars, donated articles, treasures, structures and historical remnants of Arulmighu Senthatti Ayyanar Muthaiah Swamy Thirukkovil, Keelan Marainadu Village, Sivakasi Taluk, Virudhunagar District.
Mr.P.Subbaraj, learned Special Government Pleader takes notice for the Respondents 1 to 4 and Mr.P.Mahendran, learned counsel takes notice for the Respondents 5 and 6.
The present writ petition is with reference to the temple, by name, Arulmighu Senthatti Ayyanar Muthaiah Swamy Thirukkovil in Keelan Marainadu Village, Sivakasi Taluk, Virudhunagar District and the renovation work of the said temple is being carried out by the Respondents 5 and 6. The apprehension of the Petitioner is that under the guise of renovation and maintenance of temple, the idols, stone inscriptions, pillars, donated articles, treasures, structures and historical remnants may be destroyed.
It is submitted by the learned counsel for the Petitioner that the Petitioner has sent his representation to the 4th Respondent on 01.09.2022 requesting that renovation work should not cause damage to the idols, stone inscriptions, pillars, donated articles, treasures, structures and historical remnants. It is also submitted that the above representation has not been considered and no order has been passed by the 4th Respondent till date. Though the writ petition was filed for a writ of Mandamus directing the Respondents 2 and 4 to restrain the 6th Respondent from destroying and altering the idols, stone inscriptions, pillars, donated articles, treasures, structures and historical remnants of the said temple. Now, the learned counsel for the Petitioner limit his prayer seeking a direction to the 4th Respondent to consider and pass orders on the representation of the Petitioner, dated 01.09.2022 within a time frame.
It is submitted by the learned Special Government Pleader for the Respondents 1 to 4 that the 4th Respondent would consider and pass orders on the representation of the Petitioner, dated 01.09.2022 on merits and in accordance with law within a period of four weeks. The learned Special Government Pleader for the Respondents 1 to 4 and the learned counsel for the Respondents 5 and 6 undertakes that the renovation work would not cause any damage to the idols, stone inscriptions, pillars, donated articles, treasures, structures and historical remnants in any manner and the same will remain undisturbed. It is also submitted that the renovation work has commenced and under way.
In view of the above, the 4th Respondent is directed to consider and pass orders on the representation of the Petitioner, dated 01.09.2022 on merits and in accordance with law within a period of four weeks from today. This Writ Petition stands disposed of. No costs. Consequently, connected miscellaneous petition is closed.
