Judgment
The Writ Petition is disposed of at the time of admission, after hearing the learned counsel for the petitioner, the learned Special Government Pleader for the respondents 1 to 3 and the learned Additional Government Pleader for the respondents 4 to 7, and after dispensing with notice to the private respondents, namely, the respondents 8 and 9, as no adverse orders are going to be passed against them.
The petitioner has filed this Writ Petition seeking a Writ of Mandamus to direct the respondents 1 to 3 to take over the administration of Arulmigu Shree Dharma Muneeswarar Temple and Arulmigu Shree Vaazhavanthamman Temple, situated at Vaagaiyendhal Meenachipuram Village, Paramakudi Taluk, Ramanathapuram District, and conduct the annual festival, which used to be celebrated during the month of Purattasi every year, and consequently, forbear the respondents 8 and 9 from conducting the Temple Festival from 17.09.2026 to 19.09.2026 on their own accord, by considering the petitioner’s representation dated 29.08.2026.
It is the contention of the petitioner that the private respondents have taken control of the Temple with a view to ensure that they are conferred with the first honours in the subject Temples, namely, Arulmigu Shree Dharma Muneeswarar Temple and Arulmigu Shree Vaazhavanthamman Temple, situated at Vaagaiyendhal Meenachipuram Village, Paramakudi Taluk, Ramanathapuram District.
The learned counsel for the petitioner has drawn the attention of this Court to the averments made in the affidavit, wherein it is stated that the subject Temple comes within the purview of the HR and CE Department and has been assigned Temple No.TM-035838.
The learned Special Government Pleader appearing for the respondents 1 to 3, on the other hand, would submit that the aforesaid two Temples are situated in the property of Annadhana Vinayagar Temple. It is further submitted that a Fit Person has been appointed for Annadhana Vinayagar Temple and that the request of the petitioner will be considered by the third respondent.
Recording the submission of the learned Special Government Pleader appearing for the respondents 1 to 3, this Writ Petition stands disposed of with a direction to the third respondent to consider the representation of the petitioner dated 29.08.2026, well before the Temple Festival scheduled to be held from 17.09.2026 to 19.09.2026, after affording due notice to the petitioner and the private respondents.
The Writ Petition stands disposed of with the above direction. There shall be no order as to costs. Consequently, the connected Miscellaneous Petition is closed.
