Judgment
Hon’ble Mr. Mohd. Jamshed, Member (A)
The applicant was working as Vice Principal in a Government School under Department of Education, Govt. of NCT of Delhi. On attaining the age of superannuation, she retired from the service of the respondents as Vice-Principal on 30.4.2019. By filing the present OA, the applicant is seeking the following relief(s):-
“a. Issue a writ of mandamus or any other appropriate writ (s), order (s), or direction (s) for releasing order of pensionary benefits, pension, gratuity, commuted pension and medical card and other benefits of the petitioner as she is a single lady with no other source of income and is facing financial stringencies at the age of above 60 years.
b. Issue directions to the Respondents to clear the reemployment of the petitioner which they withheld without cogent reason.
c. Pass any other or further order as may be deemed fit and proper in the facts and circumstances of the cases in favour of the petitioner.
Learned counsel for the applicant submitted that at the verge of the retirement of the applicant, the respondents levelled false allegations against her and on account of vigilance inquiry pending against the applicant, her retiral benefits such as pension, gratuity, commutation pension and other pensionary benefits were withheld. Learned counsel for the applicant further submits that as on date neither a vigilance inquiry is pending against the applicant nor an inquiry of any kind is pending against the applicant.
Learned counsel for the applicant submits that the applicant would be satisfied if the respondents are directed to release her retiral dues in a time bound manner.
Learned counsel for the respondents has no objection to such request of the applicant and submitted that the respondents would release the pensionary benefits as due and admissible to the applicant.
Having regard to the submissions made by the learned counsel for the parties and without going into the merits of the present case, the OA is disposed of with a direction to the respondents to release the admissible and due retiral benefits to the applicant within a period of six weeks from the date of receipt of copy of this order. Pending MAs, if any, shall also stand disposed of. There shall be no order as to costs.
