Judgment
Hon''ble Smt. Justice Abhilasha Kumari
present application has been filed by the applicant (Original Plaintiff) inter-alia with a prayer to take on record the documents filed along with the application. Heard Mr. Unmesh Shukla, learned advocate for Nanavati Associates on behalf of the applicant and Mr. Harshit S. Tolia, learned advocate for the respondents (Original Defendants). It is submitted by Mr. Shukla that the Suit has been instituted to restrain the respondents from infringing the applicant''s patent and seeking damages.
The applicant, therefore, seeks to produce certain relevant original documents including documents of which copies were filed together with the Plaint and Rejoinder by the applicant. It is submitted that the said original documents may be taken on record.
Mr. Harshit S. Tolia, learned advocate for the respondents, states that subject to the rights and contentions of the respondents, he has no objection, if the documents are taken on record.
In view of above, the following order is passed:
The application is allowed. The documents produced by the applicant along with the present application are directed to be taken on record of the Suit subject to the rights and contentions of the respondents. The application is disposed of, in above terms.
