Heard Ms. Y.Bhanu Sri Akhila, learned counsel for the petitioner, Sri N.Ashwani Kumar, learned Standing Counsel for the respondent Nos.1 and 2, and Ms. Sireesha Rani Vallabhaneni, learned Standing Counsel for the respondent No.5.
The grievance of the petitioner in the instant writ petition is against the action of the respondent No.1 in issuing the impugned Notification No.401/SEC-F1/2026-2, dated 12.08.2026 and the consequential Impugned Circular in Roc.No.13021/119/2025/H1, dated 22.08.2026 issued by the 2nd respondent in prescribing the qualifying date for publication of the Ward-Wise Photo Electoral Rolls of the Municipalities as 01.01.2026 instead of 12.08.2026.
The petitioner contends that he made an application seeking transposition of his name from the Electoral Roll Vijayawada to Nandigama. Accordingly, the petitioner’s name has been transposed in the voters list of the Nandigama Municipality, Sl.No.940. The petitioner is intending to contest in the ensuing Municipal Elections. However, although name of the petitioner was processed and approved, in the Electoral roll that was published in the month of August/September, 2026, the name of the petitioner is not shown, as the respondents have taken into consideration as 01.01.2026 the qualifying date. In the said regard, the petitioner has submitted the representation for consideration of incorporation of the name of the petitioner in the Electoral Roll.
Considered the submissions.
Having regard to the status of the petitioner’s application for transposition which has already been transposed to 83-Nandigama Assembly Constituency as noted from the EPIC card issued (downloaded on 28.04.2026) in the name of the petitioner, the name of the Assembly Constituency is shown as 83-Nandigama Assembly Constituency, and in light of the provisions of Section 22 and 23 of Representation of the People Act, 1950, as the EPIC card issued in the name of the petitioner reflects the transposed Assembly Constituency, as 83-Nandigama Assembly Constituency, this Court deems it appropriate to dispose of the Writ Petition with a direction to the respondent Nos.2 to 5 to pass appropriate orders forthwith to incorporate the name of the petitioner in the Electoral Roll of the 83-Nandigama Assembly Constituency.
With the above directions, the writ petition is disposed. There shall be no order as to costs.
As a sequel, miscellaneous applications pending, if any, shall also stand closed.
