Judgment

A.L. Dave, J.—Heard learned advocate for the applicant and learned Additional Public Prosecutor for the State.

Following aspects are considered:

(1) Applicants are facing charges for offences punishable under Sections 146, 147, 148, 333, 307, 332, 323 and 337 of the Indian Penal Code, Sections 3 & 7 of the Damage to Public Property Act and Section 11-A-F of the Prevention of Cruelty to Animals Act, 1960.

(2) Investigation is over and charge sheet is filed.

(3) The allegations emerging against the applicants are of serious nature as would disentitle them to bail.

(4) The applicants are alleged to have been involved in offences punishable under the provisions of the Prevention of Cruelty to Animals Act, 1960, on earlier occasion also.

In these set of circumstances, while granting bail, some conditions are required to be imposed.

The application is allowed and the applicants are ordered to be released on bail in connection with Crime Register No. I-4 of 2006 of Dholka Town Police Station on their executing a bond of Rs. 10,000/- (Rupees ten thousand only) each with one surety each of the like amount to the satisfaction of the lower Court and subject to the conditions that they shall

(a) not take undue advantage of their liberty or abuse their liberty;

(b) not act in a manner injurious to the interest of the prosecution;

(c) maintain law and order;

(d) mark their presence before the concerned Police Station on 2nd/4th Sunday of every even numbered English calendar month between 9.00 A.M. And 2.00 P.M.;

(e) not leave the State of Gujarat without prior permission of the Sessions Judge concerned;

(f) furnish the address of their residence at the time of execution of the bond and shall not change the residence without prior permission of this Court.

If breach of any of the above conditions is committed, the Sessions Judge concerned will be free to issue warrant or to take appropriate action in the matter.

Bail before the Lower Court having jurisdiction to try the case.

Rule is made absolute.

Direct service is permitted.
