Judgment
The petitioner, a resident of Kuttur village in Thrissur district, has filed this Writ Petition under Article 226 of the Constitution of India, seeking the following reliefs:
i.call for the records leading to the inclusion of the petitioner in the Rowdy History Sheet bearing No. 2552/TDR/OSD/2023 dated 23.11.2023 and quash the same by issuing a writ of writ of certiorari;
ii.issue a writ of mandamus or other writ, order or direction commanding the respondents to remove the name of the petitioner from all surveillance registers including the Rowdy History Sheet;
iii.issue a writ of mandamus or other writ, order or direction to restrain the respondents from harassing the petitioner or summoning him except in accordance with law.
The petitioner was said to have been involved in 3 crimes registered at Viyyur Police Station, Thrissur Town West Police Station and Medical College Police Station, Thrissur, respectively. In all those cases, the courts concerned have acquitted the petitioner. Exts.P1 to P3 proceedings of the courts concerned are relied on by the petitioner in support of the aforesaid contention. Now the grievance of the petitioner is that, in spite of the aforesaid acquittal by the courts concerned, the police authorities have retained his name as rowdy in the rowdy history sheet drawn up by them.
Heard the learned counsel for the petitioner and the learned Public Prosecutor representing the State of Kerala.
As per the directions of this Court, the learned Public Prosecutor has placed on record a statement of the Deputy Superintendent of Police, DCRB, Thrissur Rural, dated 13.08.2026. It is stated in the aforesaid statement that there are no cases pending against the petitioner, and that there are no available records in Thrissur Rural about the pending cases against the petitioner in Thrissur City limits. Though the police authorities concerned, including the Director General of Police, the District Police Chief, Thrissur Rural, the Deputy Superintendent of Police, Thrissur, and Station House Officers of Viyyur Police Station, Thrissur Town West Police Station, Thrissur Medical College Police Station and Ollur Police Station, are arraigned as respondents in this Writ Petition, none of the above authorities have come forward with a contention that the petitioner is involved in any Crime.
Thus, it is clear that the petitioner is not at all involved in any Crime after his acquittal by the courts concerned vide Exts.P1 to P3 proceedings. In the above circumstances, the prayer of the petitioner for a direction for the removal of his name from the rowdy history sheet, is perfectly justifiable.
In the result, the Writ Petition stands allowed as follows:
The respondents 2 to 8 are hereby directed to take necessary steps for the removal of the name of the petitioner from the rowdy history sheet, if his name is retained in any such lists maintained by the above Police Stations and offices. The direction in this regard shall be complied within a period of 3 weeks from today. The learned Public Prosecutor shall communicate this judgment to the authorities concerned.
